These Terms of Service ("Terms") constitute a legally binding agreement between you and My First Pup, operated by Robert Do ("Company," "we," "us," or "our"), governing your access to and use of the website located at myfirstpup.com (the "Site") and all related products, services, and digital content we offer (collectively, the "Services").

By accessing or using our Site, submitting an opt-in form, making a purchase, or using the Pup Progress Tracker or any other product, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.

If you do not agree to these Terms, you must immediately discontinue use of our Site and Services.

Our Services

My First Pup provides the following products and services:

  • My First Pup (digital book) — A downloadable guide for first-time dog owners covering puppy training, socialization, and development
  • Pup Progress Tracker — A subscription-based digital application for tracking puppy training milestones, health records, and daily routines
  • Email and SMS communications — Educational and promotional content delivered via email and text message to subscribers

Important Notice: All content provided by My First Pup, including the book, the tracker, and all website content, is for general informational and educational purposes only. It is not a substitute for professional veterinary, behavioral, or medical advice. Always consult a licensed veterinarian for health-related decisions about your pet.

Eligibility

You must be at least 18 years of age to use our Services or make a purchase. By using our Site, you represent and warrant that you are 18 or older and have the legal capacity to enter into a binding agreement.

If you are accessing our Services on behalf of a business or organization, you represent that you have the authority to bind that entity to these Terms.

Our Services are intended for use in the United States. We make no representation that our Services are appropriate or available in other locations. If you access our Services from outside the US, you do so at your own risk and are responsible for compliance with local laws.

Accounts and Registration

Some of our Services, including the Pup Progress Tracker, may require you to create an account. When you register, you agree to:

  • Maintain and promptly update your account information
  • Keep your password confidential and not share it with others
  • Notify us immediately of any unauthorized use of your account at [email protected]
  • Be solely responsible for all activity that occurs under your account

We reserve the right to suspend or terminate your account at any time if we believe you have violated these Terms, provided false information, or engaged in any activity that may harm us, other users, or third parties.

You may have only one account per person. Creating multiple accounts to circumvent restrictions or access free trials more than once is prohibited.

Section 5

Purchases and Payment

When you make a purchase through our Site, you agree to provide current, complete, and accurate payment information. All prices are listed in US dollars unless otherwise stated.

By submitting a payment, you authorize us to charge your payment method for the total amount of your order, including any applicable taxes or fees. We use Stripe and other PCI-compliant payment processors to handle all transactions. We do not store your full credit card information on our servers.

We reserve the right to refuse or cancel any order at our discretion, including in cases of pricing errors, suspected fraud, or unavailability of a product. If we cancel an order after payment has been processed, we will issue a full refund.

All sales are final for digital products once the download link or access credentials have been delivered, except as described in our Refund Policy in Section 6.

Section 6

Refund Policy

Digital Downloads

Due to the nature of digital products, all sales of downloadable content (including the My First Pup ebook) are final and non-refundable once the download link has been delivered to your email or phone. By completing your purchase, you acknowledge and agree to this policy.

If you did not receive your download link or experienced a technical issue preventing access, please contact us at [email protected] within 7 days of purchase and we will resolve the issue promptly.

Pup Progress Tracker Subscriptions

Subscription fees are charged at the beginning of each billing period and are non-refundable for the current billing period. You may cancel your subscription at any time and will retain access to the Service through the end of your current paid period.

Free trial periods are non-renewable. If you cancel during your free trial, you will not be charged. If you do not cancel before the trial ends, you will be charged the applicable subscription rate.

Exceptions

We may issue refunds at our sole discretion in cases of duplicate charges, billing errors, or extraordinary circumstances. To request a refund consideration, contact us at [email protected] with your order details.

Section 7

Digital Products and License

Upon purchase and payment of the applicable fee, we grant you a limited, non-exclusive, non-transferable, personal license to access and use the digital content you have purchased for your own personal, non-commercial use.

This license does not permit you to:

  • Copy, reproduce, distribute, or share the content with others (including uploading to file-sharing sites)
  • Sell, resell, or sublicense the content
  • Use the content for commercial purposes, including in courses, workshops, or for-profit presentations
  • Modify, adapt, translate, or create derivative works based on the content
  • Remove any copyright, trademark, or proprietary notices from the content

Your license to use the digital product is personal to you and may not be transferred to any other person. Unauthorized distribution of our digital products is a violation of copyright law and these Terms.

Section 8

Subscription Terms (Pup Progress Tracker)

The Pup Progress Tracker is offered on a subscription basis. The following terms apply to all subscriptions:

Billing

Subscriptions are billed on a recurring basis (monthly or annually, depending on the plan selected) at the rate displayed at the time of purchase. Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date.

Free Trials

We may offer free trial periods for the Pup Progress Tracker. No credit card is required to begin a free trial unless expressly stated. At the end of the free trial, you will either need to provide payment information to continue or your access will end. You will not be charged without your explicit consent.

Cancellation

You may cancel your subscription at any time through your account settings or by contacting us at [email protected]. Cancellation takes effect at the end of the current billing period. You will not receive a prorated refund for unused time in your current period.

Price Changes

We reserve the right to change subscription pricing at any time. We will provide at least 30 days' advance notice of any price increase via email to the address associated with your account. Your continued use of the Service after the price change takes effect constitutes acceptance of the new price.

Service Availability

We strive to maintain consistent availability of the Pup Progress Tracker but do not guarantee uninterrupted access. We may perform maintenance, updates, or improvements that temporarily affect availability. We are not liable for any downtime or service interruptions.

Section 9

SMS and Email Communications

By submitting your phone number with SMS consent on any of our forms, you agree to receive text messages from My First Pup. By submitting your email address, you agree to receive email communications from us.

SMS Terms: Message and data rates may apply. Message frequency varies. Reply STOP to cancel. Reply HELP for help. Consent is not a condition of any purchase.

You may opt out of SMS messages at any time by replying STOP to any message we send. You may opt out of email marketing by clicking the Unsubscribe link in any marketing email. Please note that opting out of marketing communications does not opt you out of transactional messages (such as order confirmations and download links) related to active purchases or accounts.

We comply with all applicable federal and state laws governing electronic communications, including the Telephone Consumer Protection Act (TCPA), the CAN-SPAM Act, and applicable state laws.

Acceptable Use

You agree to use our Site and Services only for lawful purposes and in accordance with these Terms. You agree not to:

  • Violate any applicable federal, state, local, or international law or regulation
  • Use the Site in any way that could damage, disable, overburden, or impair our servers or networks

The name "My First Pup," the Pup Progress Tracker name and logo, and all related marks, names, and slogans are trademarks of Robert Do. You may not use these marks without our prior written permission.

Nothing in these Terms grants you any right, title, or interest in our intellectual property beyond the limited license described in Section 7. Any unauthorized use of our content or marks may violate copyright, trademark, and other applicable laws.

Disclaimers and No Warranties

Read carefully. This section limits our liability to you. Our services are provided "as is" without warranties of any kind.

Individual training results will vary significantly depending on effort, consistency, the dog's individual characteristics, and other factors.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MY FIRST PUP, ROBERT DO, OR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY:

  • Indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, data, goodwill, or other intangible losses
  • Damages resulting from your use of or inability to use our Services
  • Damages resulting from any content obtained through our Services
  • Damages for personal injury or property damage related to your use of our Services or your pet's behavior

WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN JURISDICTIONS THAT DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, OUR LIABILITY IS LIMITED TO THE GREATEST EXTENT PERMITTED BY LAW.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF OUR SERVICES EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) $100.

Indemnification

You agree to defend, indemnify, and hold harmless My First Pup, Robert Do, and their respective officers, directors, employees, agents, licensors, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

  • Your violation of these Terms
  • Your use of the Site or Services in a manner not authorized by these Terms
  • Any content you submit, post, or transmit through the Site
  • Your violation of any third party's rights, including intellectual property rights
  • Your violation of any applicable law or regulation
Section 15

Dispute Resolution and Arbitration

Informal Resolution First

Before initiating any formal dispute, you agree to contact us at [email protected] and give us a reasonable opportunity (at least 30 days) to resolve the issue informally. Most concerns can be resolved quickly and to your satisfaction this way.

Binding Arbitration

If we cannot resolve a dispute informally, you and My First Pup agree that any dispute, claim, or controversy arising out of or relating to these Terms or the use of our Services shall be resolved by binding arbitration, rather than in court, except that either party may bring claims in small claims court if they qualify.

Arbitration shall be conducted by a neutral arbitrator under the rules of the American Arbitration Association (AAA). The arbitration will be conducted in English and, unless both parties agree otherwise, will be conducted in the state of California. The arbitrator's decision will be final and binding.

Class Action Waiver

YOU AND MY FIRST PUP AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, REPRESENTATIVE, OR COLLECTIVE PROCEEDING. If this class action waiver is found to be unenforceable, then the arbitration clause shall be null and void.

Exceptions

Nothing in this section shall prevent either party from seeking injunctive or other equitable relief in a court of competent jurisdiction where necessary to prevent irreparable harm, including claims relating to intellectual property infringement or data security.

Section 16

Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.

For any matters not subject to arbitration, you and My First Pup consent to the exclusive jurisdiction and venue of the state and federal courts located in California. You waive any objection to the laying of venue of any such proceeding in California.

Third-Party Links and Services

Our Site may contain links to third-party websites, products, or services that are not owned or controlled by My First Pup. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party sites or services.

We strongly advise you to read the terms and privacy policies of any third-party sites you visit. Our inclusion of a link to a third-party site does not constitute an endorsement of that site or its content.

Our use of third-party service providers (including GoHighLevel, Stripe, Meta, and Google) is subject to their respective terms of service and privacy policies.

Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. A waiver of any provision must be in writing and signed by an authorized representative of My First Pup.

Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction.

Force Majeure

We will not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including natural disasters, pandemics, internet outages, power failures, or government actions.
